1. Introduction

These Terms of Service (“Terms”) govern your use of BOOSTIFIED—Pay (“BOOSTIFIED—Pay”, “we”, “us”, “our”), a platform operated by Boostified AB, Malmö, Sweden.

By creating a User account, you agree to be legally bound by these Terms.

A User may create, own, and manage multiple Workspaces and invite additional team members. These Terms apply to the User, all Workspaces created by the User, and all activities performed through the platform.

Separate Creator Campaign Terms apply to individual collaborations between creators and brands and do not replace these Terms.

2. Eligibility

To register a User account, you must:

  • Be at least 18 years old

  • Provide accurate and complete information

  • Use the platform only for lawful purposes

  • Comply with these Terms at all times

BOOSTIFIED—Pay may suspend or terminate accounts in cases of misuse, non-compliance, fraud, or risk to the platform.

3. User Accounts

Your User account is personal and non-transferable. You are responsible for:

  • Securing your login credentials

  • All activity performed under your account

  • Ensuring invited team members comply with these Terms

Deleting your User account does not automatically delete any Workspace you have created.

4. Workspaces

4.1 Workspace Ownership

The User who creates a Workspace is the Workspace Owner and retains full administrative control. Workspace ownership does not transfer automatically if the User leaves the platform or deletes their main account.

4.2 Team Members

Workspace Owners may invite team members and assign permissions. Workspace Owners remain fully responsible for:

  • All actions performed within the Workspace

  • Permissions granted to team members

  • Ensuring all members comply with these Terms

4.3 Workspace Data

Workspace-specific data is stored separately. Deleting a Workspace permanently removes its data except where retention is required by law.

5. Acceptable Use

You may not upload, submit, or distribute content (“Content”) that:

  • Is illegal, harmful, hateful, defamatory, violent, or discriminatory

  • Promotes or involves misogyny, racism, homophobia, extremism, or harassment

  • Sexualizes individuals or depicts explicit sexual content

  • Involves minors in unsafe or sexualized contexts

  • Encourages unlawful or dangerous activities

  • Violates advertising, consumer, or marketing regulations

  • Infringes intellectual property rights

  • Violates GDPR or privacy laws

  • Contains malware, phishing links, harmful code, or security threats

  • Damages or risks the reputation of BOOSTIFIED—Pay

We may remove any Content and suspend accounts without prior notice if these rules are violated.

6. Marketplace Terms (Campaign Listings)

BOOSTIFIED—Pay provides a Marketplace where brands, agencies, and companies (“Campaign Creators”) may publish campaigns, briefs, and requests for user-generated content (UGC) and influencer collaborations (“Campaign Listings”). Use of the Marketplace is subject to the following rules and restrictions.

6.1 Responsibility for Campaign Listings

Campaign Creators are solely responsible for all information, instructions, assets, claims, and requirements included in their Campaign Listings.
BOOSTIFIED—Pay does not create, approve, or endorse Marketplace content prior to publication and assumes no responsibility for its legality, accuracy, or compliance.

Campaign Listings must be accurate, lawful, and suitable for public display to creators.

6.2 Prohibited Campaign Listings

Campaign Creators may not publish Campaign Listings that include, promote, or require any of the following:

Illegal, harmful, or inappropriate content

Campaign Listings may not contain or encourage:

  • Illegal activities under EU, EEA, or local law

  • Hate speech, harassment, discrimination, or abusive behavior

  • Violence, threats, or incitement to harm

  • Sexually explicit content or sexualized depictions

  • Any involvement of minors in sexual, unsafe, or exploitative contexts

  • Content that endangers creators or encourages unlawful behavior

Non-compliant or misleading marketing

Listings may not include:

  • False, misleading, or unverifiable advertising claims

  • Instructions that violate consumer protection or marketing regulations

  • Industry-restricted content posted without legally required disclosures (e.g., alcohol, gambling, financial products, pharmaceuticals, CBD, supplements)

  • Political advertising, political influence campaigns, or election-related content

Intellectual property and privacy violations

Campaign Creators may not:

  • Upload or request the use of copyrighted materials without permission

  • Misuse trademarks, logos, brand assets, or proprietary images

  • Request creators to infringe on intellectual property, privacy, or publicity rights

6.3 Use of External Platforms (Strictly Prohibited for Marketplace Campaigns)

To protect creators and ensure compliance, Campaign Creators may not use external systems for any part of a Marketplace campaign.

This includes prohibiting any requirement or instruction for creators to:

  • Register or create accounts on external platforms

  • Move communication outside BOOSTIFIED—Pay

  • Submit deliverables or content elsewhere

  • Track performance, conversions, or affiliate data on external systems

  • Complete onboarding, verification, or approval workflows on external services

  • Receive payment, commissions, or affiliate rewards via third-party portals

Examples of prohibited external platforms include (but are not limited to):

  • Discord

  • Affiliate portals or affiliate networks

  • Private communities or forums

  • External forms or registration tools

  • Messaging apps (e.g., WhatsApp, Telegram, Messenger)

  • Third-party tracking dashboards

  • External content submission systems

All Marketplace campaigns must be fully managed inside BOOSTIFIED—Pay, including registration, briefing, communication, submission, approval, tracking, and payment.

Directing creators away from BOOSTIFIED—Pay is considered a violation of these Terms.

6.4 Removal and Enforcement

BOOSTIFIED—Pay may, at its sole discretion and without prior notice:

  • Remove or hide any Campaign Listing

  • Disable Marketplace access

  • Suspend or terminate the User account or Workspace responsible

  • Report unlawful behavior to relevant authorities

This applies especially to listings involving illegal activity, unsafe tasks, harmful content, or any use of external systems that bypass BOOSTIFIED—Pay.

6.5 Reporting Violations

Creators and Users may report inappropriate or unlawful Campaign Listings via info@boostifiedpay.com.
BOOSTIFIED—Pay reviews all reports and may take immediate action.

6.6 No Guarantee or Endorsement

BOOSTIFIED—Pay does not guarantee the accuracy, legality, or safety of Campaign Listings.
BOOSTIFIED—Pay is not responsible for:

  • The conduct or commitments of Campaign Creators

  • Compliance with advertising or industry regulations

  • Creator selection or compensation

  • The outcome of any collaboration

All agreements related to Marketplace campaigns occur directly between the Creator and the Campaign Creator.

7. Payments & Billing

Fees for paid plans, add-ons, or usage-based services are shown at billing.
By subscribing, you authorize BOOSTIFIED—Pay to charge your chosen payment method.

Fees may include VAT where required under EU law.
Failure to pay may result in Workspace suspension or account termination.

8. Content Ownership & Licensing

8.1 Ownership

You retain ownership of any Content you upload (“Workspace Content”).

8.2 License to BOOSTIFIED—Pay

By uploading Workspace Content, you grant BOOSTIFIED—Pay a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:

  • Host, store, process, and display the content

  • Use the content for BOOSTIFIED—Pay marketing and promotion, including:

    • Website

    • Social channels

    • Product demos

    • Ads

    • Sales materials

This license applies per Workspace and remains valid after termination unless you request removal.

Content removal requests can be sent to privacy@boostifiedpay.com.

8.3 Rights and Permissions

You confirm that you have all necessary rights to upload and license the content.

9. Communications & Newsletters

By creating a User account, you agree that BOOSTIFIED—Pay may send:

  • Service notifications

  • Account and security alerts

  • Product updates

  • Marketing emails and newsletters

Marketing emails are automatic for all Users.
You may opt out at any time through the unsubscribe link or notification settings.

Transactional emails cannot be opted out of as they are required for service delivery.

10. Data Protection & GDPR

BOOSTIFIED—Pay processes personal data according to the General Data Protection Regulation (GDPR).

11. Confidentiality

All Workspace data, communications, files, and information are treated as confidential except when disclosure is required by law or necessary for security and compliance.

12. Termination

12.1 By the User

You may delete your User account or any Workspace at any time.

12.2 By BOOSTIFIED—Pay

We may suspend or terminate your User account or Workspace access if you:

  • Breach these Terms

  • Post illegal or harmful content

  • Fail to pay fees when due

  • Create security or compliance risks

  • Misuse the Marketplace

  • Engage in fraudulent or unlawful activity

Termination does not affect existing legal or financial obligations.

13. Liability

BOOSTIFIED—Pay is provided “as is” without warranties.

We are not liable for:

  • Lost data

  • Loss of revenue, profits, or contracts

  • Business interruption

  • Third-party content or misuse

  • Indirect, incidental, or consequential damages

Our maximum liability is €100 or the total amount paid to BOOSTIFIED—Pay in the past 6 months — whichever is higher.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Sweden.

Any dispute shall be finally resolved by arbitration administered by the Stockholm Chamber of Commerce (SCC), in English or Swedish.

15. Changes to Terms

We may update these Terms at any time.
We will notify Users via email or in-app notifications.
Continued use of the platform constitutes acceptance of updated Terms.
